These Terms and Conditions (“Terms”) govern your access to and use of the Clariven™ website located at www.clariven.net (the “Site”), operated by Clariven LLC (“Clariven,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Clariven™

Clariven™ is a game-based Medicare education platform available for licensing by insurance professionals, organizations, and insurance carriers. The Site provides information about the Clariven™ system and allows visitors to submit licensing inquiries.

2. Use of the Site

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to:

•  Use the Site in any way that violates applicable federal, state, or local laws or regulations

•  Reproduce, duplicate, copy, sell, or exploit any portion of the Site without express written permission from Clariven LLC

•  Attempt to gain unauthorized access to any part of the Site or its related systems

•  Use the Site to transmit any unsolicited or unauthorized advertising or promotional material

3. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, images, and the Clariven™ name and mark — is the property of Clariven LLC and is protected by applicable intellectual property laws. Clariven™ is a trademark of Clariven LLC. Unauthorized use of any content or marks from this Site is strictly prohibited.

The Clariven™ Medicare education system, including all components and materials, constitutes proprietary intellectual property of Clariven LLC. Nothing on this Site grants any license or right to use Clariven™ system materials without a fully executed licensing agreement.

4. Licensing Inquiries & Licensee Compliance Responsibility

Submitting a licensing inquiry through the Site does not create a binding agreement, obligation, or license of any kind. Licensing is subject to a separate written licensing agreement executed by both parties. Clariven LLC reserves the right to accept or decline any licensing inquiry at its sole discretion.

Clariven™ materials are provided for general Medicare educational purposes only. Licensees are solely responsible for ensuring their use of Clariven™ materials complies with all applicable CMS Medicare marketing guidelines, state insurance department regulations, and any other federal or state requirements governing their specific activities. This includes but is not limited to compliance with CMS marketing rules applicable to licensed insurance agents, brokers, and carriers. Clariven LLC makes no representations or warranties regarding the regulatory compliance of any licensee's use of the system.

5. No Medicare Affiliation

Clariven™ is an independent Medicare education platform. It is not affiliated with Medicare, the Centers for Medicare & Medicaid Services (CMS), the U.S. Department of Health and Human Services, or any government agency. Nothing on this Site constitutes Medicare enrollment assistance, plan recommendation, or insurance advice. Nothing in the Clariven™ system constitutes a Medicare plan document, enrollment form, Evidence of Coverage, or any other CMS-regulated communication.

6. Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. Clariven LLC makes no warranty that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. The information on this Site is provided for general informational purposes only and is subject to change without notice.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Clariven LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Site, even if Clariven LLC has been advised of the possibility of such damages. Clariven LLC’s total liability for any claim arising from your use of the Site shall not exceed one hundred dollars ($100.00).

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas.

Clariven LLC reserves the right to update or modify these Terms at any time. Changes will be effective upon posting to the Site with an updated effective date. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.
